These Terms of Use govern your access to and use of the services, platform, and tools provided by Savelind ("we," "us," or "our") at savelind.com. By accessing or using our services, you agree to be bound by these terms. If you do not agree, you must discontinue use immediately.
1. Acceptance of Terms
By creating an account, accessing any part of the platform, or otherwise using our services, you confirm that you have read, understood, and agree to these Terms of Use, along with any additional policies referenced herein. These terms form a legally binding agreement between you and Savelind.
If you are using the services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Services
Savelind provides a cloud-based platform for chatbot analytics and performance monitoring. This includes tools for tracking conversational data, measuring engagement metrics, generating performance reports, and supporting continuous improvement of automated messaging systems.
We reserve the right to modify, suspend, or discontinue any aspect of the services at any time with reasonable notice where practicable.
3. Eligibility
You must be at least 18 years of age to use our services. By using the platform, you represent and warrant that you meet this age requirement and that you are not prohibited from using the services under any applicable law or regulation.
4. Account Registration and Security
4.1 Account Creation
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.
4.2 Account Responsibility
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@savelind.com if you suspect any unauthorized access or security breach.
4.3 Account Sharing
You may not share your account credentials with third parties or allow others to access the platform using your credentials unless expressly authorized under your subscription plan.
5. Permitted Use
You agree to use the platform solely for lawful purposes and in accordance with these terms. You are permitted to:
- Access and use the features available under your subscription tier
- Generate reports and export data related to your own chatbot deployments
- Invite team members to collaborate within your account as permitted by your plan
- Integrate the platform with third-party services using supported methods
6. Prohibited Conduct
You must not engage in any of the following activities:
- Reverse-engineering, decompiling, or attempting to extract the source code of the platform
- Uploading or transmitting malicious code, viruses, or any software designed to interfere with the platform
- Using automated tools to scrape, crawl, or extract data from the platform without written authorization
- Attempting to gain unauthorized access to any system, account, or data
- Reproducing, reselling, or sublicensing access to the platform or its features without explicit written permission
- Using the services to process or store data in a manner that violates applicable privacy laws or the rights of third parties
- Impersonating any person or entity or misrepresenting your affiliation with any person or entity
- Engaging in any conduct that could damage, disable, or impair the performance of the services
7. Intellectual Property
7.1 Our Intellectual Property
All content, technology, software, branding, and materials available through the platform are the exclusive property of Savelind or its licensors and are protected by applicable intellectual property laws. Nothing in these terms grants you any ownership rights in the platform or its underlying technology.
7.2 Your Data
You retain ownership of the data you input into the platform, including chatbot logs, performance data, and configuration information. By using the services, you grant us a limited license to process and store your data solely for the purpose of providing and improving the services.
7.3 Feedback
If you provide suggestions, feedback, or ideas regarding the platform, you grant us a perpetual, royalty-free right to use such feedback for any purpose without obligation to you.
8. Subscriptions and Payment
8.1 Subscription Plans
Access to certain features requires a paid subscription. Details of available plans, pricing, and features are described on the platform and may be updated from time to time.
8.2 Billing
By subscribing, you authorize us to charge the applicable fees to your designated payment method on a recurring basis according to the plan you selected. All fees are stated in the currency applicable to your billing region.
8.3 Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods unless required by applicable law or otherwise stated in a separate agreement.
8.4 Price Changes
We may modify pricing with advance notice. Continued use of the services after the effective date of a price change constitutes your acceptance of the new pricing.
9. Confidentiality
Each party agrees to keep the other party's confidential information strictly confidential and not to disclose it to third parties without prior written consent, except as required by law. Confidential information does not include information that is publicly available, independently developed, or lawfully obtained from a third party.
10. Privacy
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using the services, you consent to the collection, use, and processing of your information as described in the Privacy Policy.
11. Third-Party Integrations
The platform may integrate with or link to third-party services. We do not control and are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed by their respective terms and policies.
12. Service Availability
We strive to maintain platform availability but do not guarantee uninterrupted or error-free access. Scheduled maintenance, unexpected outages, or circumstances beyond our reasonable control may temporarily affect service availability. We will make reasonable efforts to provide advance notice of planned maintenance.
13. Disclaimer of Warranties
The services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will meet your specific requirements or that any data or outputs generated by the platform will be accurate or complete.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Savelind and its affiliates, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the services, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising under these terms shall not exceed the fees paid by you to Savelind in the twelve months preceding the event giving rise to the claim.
15. Indemnification
You agree to indemnify, defend, and hold harmless Savelind and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the services, your violation of these terms, or your infringement of any third-party rights.
16. Termination
16.1 Termination by You
You may terminate your account at any time by contacting us at support@savelind.com or using the account closure option within the platform settings.
16.2 Termination by Us
We reserve the right to suspend or terminate your access to the services at our sole discretion, with or without notice, if we determine that you have violated these terms, engaged in fraudulent activity, or posed a risk to the platform or other users.
16.3 Effect of Termination
Upon termination, your right to access the services ceases immediately. Provisions of these terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitation of liability, and indemnification — shall remain in effect.
17. Modifications to These Terms
We may update these Terms of Use at any time. When changes are made, we will revise the date at the top of this page and, where the changes are material, provide notice through the platform or by email. Continued use of the services after changes become effective constitutes your acceptance of the revised terms.
18. Governing Law and Dispute Resolution
These terms are governed by generally accepted principles of commercial law applicable to online services. Any disputes arising in connection with these terms shall first be addressed through good-faith negotiation. If resolution cannot be reached informally, disputes shall be submitted to binding arbitration or the appropriate legal forum as mutually agreed upon by the parties.
19. Severability
If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
20. Entire Agreement
These Terms of Use, together with the Privacy Policy and any other policies or agreements incorporated by reference, constitute the entire agreement between you and Savelind regarding your use of the services and supersede all prior agreements or understandings on the same subject matter.
